Justice Department and Federal Partners Announce Enforcement Actions of Dietary Supplement Cases

Criminal Charges Brought against Bestselling Supplement Manufacturer

As part of a nationwide sweep, the Department of Justice and its federal partners have pursued civil and criminal cases against more than 100 makers and marketers of dietary supplements.  The actions discussed today resulted from a year-long effort, beginning in November 2014, to focus enforcement resources in an area of the dietary supplement market that is causing increasing concern among health officials nationwide.  In each case, the department or one of its federal partners allege the sale of supplements that contain ingredients other than those listed on the product label or the sale of products that make health or disease treatment claims that are unsupported by adequate scientific evidence.

Among the cases announced today is a criminal case charging USPlabs LLC and several of its corporate officers.  USPlabs was known for its widely popular workout and weight loss supplements, which it sold under names such as Jack3d and OxyElite Pro.

According to the DOJ, USP Labs in Texas imported bulk isolated chemical ingredients from China, and then mislabeled them as plant-based ingredients. They also engaged in deceptive marketing and even the chemical adulteration of their product, says the DOJ, causing liver damage in numerous customers and putting hundreds of thousands of people at risk.

In a widely publicized announcement today, the DOJ, FDA, FTC and DoD all urged consumers to beware of what they call “high risk supplements” which are;

Weight loss dietary supplements made with chemical stimulants and marketed with outrageous claims of magical weight loss.

Bodybuilding supplements made with chemical ingredients that promise unreal muscle gains but actually contain potentially hazardous chemicals.

Performance-enhancing supplements that may contain banned substances (doping)which may also pose a risk to consumers.

Criminal indictments were handed down today against at least four executives of the USP Labs company in Texas, plus at least 20 warning letters have been sent out to other companies for engaging in what the federal government described as misleading, even “criminal” behavior.

While most of the dietary supplement industry operates ethically and honestly, a few bad apples are raking in millions of dollars each month in sales of dishonest, chemically adulterated products that endanger the public.

Basically, consumers have been buying dummy pills this whole time. No wonder you hear people saying, “Supplements don’t work!” How can they work when they don’t have what’s listed on the labels!

Each year an estimated 325,000 people die in the United States from Sudden Cardiac Arrest (SCA). Of that number the Heart Rhythm Society estimates about 7,000 of these deaths are in children and infants.

While most victims are in their 60s and 70s, the latest study by Centers for Disease Control reported today that the rate of young people dying from cardiac arrest has soared in the last 10 years.

The CDC says there are 3,000 of these deaths annually among Americans age 15 to 34, a 10 percent increase during the past decade.

“We’re talking about young adults,” says Dr. George Mensah of the Centers for Disease Control, “who have no symptoms and who die suddenly, sometimes within an hour of having their first onset of symptoms.”
